WHAT IS TENANCY CONTRACT?

A tenancy contract is a civil law agreement, between the landlord and the tenant in order to establish all parameters of the transaction.   • Breaking the tenancy contract is only possible if both parties agree to it; unless they agree otherwise, the contract term should be renewed after 1 year if the tenants continue to live on the property.
  • Early termination of tenancy contracts is not mentioned specifically in the tenancy law. However, if the tenant chooses to vacate the property before the end of the contractual term, the landlord has the right to refuse the remaining rent refund. If the original rent contract has an exit clause that addresses the early termination of tenancy and clearly outlines the required notice period and the amount of penalty to be charged to tenants, the amount of penalty payable on early termination of tenancy contracts depends on the termination clause included in the agreement. If there is no termination clause mentioned in the agreement, the tenant must give at least 60 days’ notice for termination. And if the property is transferred to a new owner before the conclusion of the tenancy period, the tenant has the right to live there until the end of the contractual term
  • The landlord has no permission to enter the leased property in the absence of the tenants. Tenant’s consent is required even if the landlord wishes to sell the property and conduct property viewings on the premises, and also need to provide a 24-hour notice for the viewings to take place after the tenant grants permission.
  • There are no particular benefits or special rights for tenants on the property, regardless of how long the rental agreement has been in effect.
  • In case of any unsolvable issues between the landlord and tenant, the parties can always file a rent dispute with the Rental Dispute Settlement Centre.
